NexoMAB is a software platform that provides AI-powered marketing, content generation, scheduling, publishing, automation, analytics, reporting, and related services.

Features may change, be modified, suspended, or discontinued at any time without notice.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Services.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

You agree to provide accurate information and keep your account information up to date.

5. Subscription Plans and Billing

Certain features require a paid subscription.

By subscribing, you authorize recurring charges using your selected payment method until cancellation.

Subscription fees may change at any time. Changes will apply to future billing periods.

6. No Refund Policy

ALL PAYMENTS ARE FINAL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXOMAB DOES NOT PROVIDE REFUNDS, PARTIAL REFUNDS, CREDITS, OR EXCHANGES FOR:

  • Subscription fees
  • Unused subscription periods
  • Unused features
  • User error
  • Change of mind
  • Business performance
  • Marketing results
  • Advertising outcomes
  • Campaign performance

Users are responsible for evaluating the Services before purchasing.

7. User Content

You retain ownership of content you create or upload.

You grant NexoMAB a limited license to store, process, reproduce, transmit, and display such content solely for the purpose of providing the Services.

8. AI Generated Content Disclaimer

NexoMAB may generate content using artificial intelligence systems.

AI-generated content may contain inaccuracies, errors, omissions, biased outputs, or inappropriate content.

You are solely responsible for reviewing, editing, approving, and verifying all generated content before use or publication.

9. Acceptable Use

You agree not to:

  • Violate any law or regulation
  • Infringe intellectual property rights
  • Distribute malware or harmful code
  • Attempt unauthorized access
  • Interfere with platform operations
  • Use the platform for fraud or deception
  • Abuse social media platform policies

10. Third-Party Services

NexoMAB integrates with third-party services including but not limited to Meta, Facebook, Instagram, LinkedIn, Stripe, OpenAI, and other providers.

We are not responsible for the availability, actions, policies, or decisions of any third-party service.

11. Service Availability

We do not guarantee uninterrupted availability, uptime, error-free operation, or continuous access to the Services.

Maintenance, outages, third-party failures, API changes, or other events may affect availability.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXOMAB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE MAKE NO GUARANTEE REGARDING:

  • Revenue generation
  • Lead generation
  • Business growth
  • Campaign success
  • Marketing performance
  • Social media engagement
  • Search rankings
  • Advertising results

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXOMAB, ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • Lost profits
  • Lost revenue
  • Lost business opportunities
  • Loss of goodwill
  • Loss of data
  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Punitive damages

ARISING OUT OF OR RELATED TO THE USE OF THE SERVICES.

IN NO EVENT SHALL NEXOMAB'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER TO NEXOMAB DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless NexoMAB, its owners, affiliates, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your use of the Services
  • Your content
  • Your violation of these Terms
  • Your violation of applicable laws
  • Your violation of third-party rights

15. Account Suspension and Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any reason including suspected abuse, fraud, policy violations, legal concerns, or operational reasons.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where NexoMAB operates, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
